By accessing and using the Cohen Law Denver Client Portal ("Portal") at cohenlawclientportal.com, you ("Client," "User," or "you") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Cohen Law Denver ("Firm," "we," "us," or "our").
If you do not agree to these Terms, you must not access or use the Portal
The Portal is a secure online platform that allows clients of Firm to:
- Create and maintain user accounts
- Upload, store, and manage legal documents related to their bankruptcy cases
- Communicate securely with attorneys and staff
- Monitor case progress and receive updates
- Access case-related information and documents
The Portal is intended solely for use by current clients of Firm in connection with their legal matters.
Eligibility and Account Registration
To use the Portal, you must:
- Be at least 18 years of age
- Be a current client of Firm with an active legal matter
- Have the legal capacity to enter into binding agreements
- Provide accurate and complete registration information
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use of your account
- Using strong passwords and updating them regularly
We reserve the right to suspend or terminate your account at any time for:
- Violation of these Terms
- Completion or termination of your legal matter
- Inactivity for an extended period
- Security concerns
You may use the Portal only for:
- Legitimate legal purposes related to your case
- Uploading documents requested by your attorney
- Communicating with Firm regarding your legal matter
- Accessing information about your case
You may not:
- Use the Portal for any unlawful purpose
- Upload malicious software, viruses, or harmful code
- Attempt to gain unauthorized access to the Portal or other users' accounts
- Share your account credentials with third parties
- Upload content that infringes intellectual property rights
- Use the Portal to harass, threaten, or harm others
- Interfere with the Portal's operation or security measures
- Upload false, misleading, or fraudulent information
Privacy and Data Protection
Attorney-Client Privilege
All communications and documents shared through the Portal are protected by attorney-client privilege and work product doctrine, where applicable.
We collect and use your personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Portal, you consent to such collection and use.
We implement industry-standard security measures to protect your data, including:
- SSL encryption for data transmission
- Secure data storage protocols
- Regular security audits and updates
- Access controls and user authentication
We will retain your data for as long as necessary to provide legal services and as required by applicable laws and professional obligations. All data will be deleted when the case is closed (so keep a backup).
Document Upload and Management
Firm does not get notified when documents are uploaded. It is your responsibility to advise us when documents are uploaded.
- All uploaded documents must be relevant to your legal matter
- Documents should be in commonly accepted formats (PDF, DOC, DOCX, JPG, PNG)
- File sizes are limited to [specify size limit, e.g., 25MB] per document
- You must have the legal right to upload and share all documents
You represent and warrant that all uploaded documents are:
- Accurate and complete
- Authentic and unaltered (unless specifically noted)
- Legally obtained
- Free from viruses or malicious code
- We will maintain uploaded documents for the duration of your case and as required by law
- Backup copies may be stored on secure servers
- You are responsible for maintaining your own copies of important documents
Intellectual Property Rights
The Portal, including its design, functionality, and content, is owned by Firm and protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to use the Portal solely for your legal matter with Firm.
You retain ownership of documents and content you upload, but grant us a license to use, store, and process such content to provide legal services.
Disclaimers and Limitations
- The Portal is provided "as is" without warranties of any kind
- We do not guarantee uninterrupted or error-free service
- Scheduled maintenance may temporarily limit access
- Technical issues may occasionally affect Portal functionality
No Legal Advice via Portal
- The Portal is a communication and document management tool only
- Use of the Portal does not create an attorney-client relationship
- Legal advice is provided only through direct attorney consultation
- Information on the Portal should not be relied upon as legal advice
The Portal may integrate with third-party services. We are not responsible for the availability, accuracy, or reliability of such services.
To the fullest extent permitted by law:
- Our total liability for any claims related to the Portal shall not exceed the fees paid for legal services
- We shall not be liable for indirect, incidental, punitive, or consequential damages
- We are not liable for damages caused by third parties, technical failures, or force majeure events
- Users assume responsibility for backing up their own data
You agree to indemnify and hold harmless Firm, its attorneys, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the Portal
- Violation of these Terms
- Infringement of third-party rights
- Your uploaded content or communications
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Portal. Continued use of the Portal after changes constitutes acceptance of the modified Terms. Material changes will be communicated via email or Portal notification.
You may terminate your account at any time by contacting Firm or using the account deletion feature.
We may terminate your access immediately for violation of these Terms or completion of your legal matter.
Upon termination:
- Your access to the Portal will be revoked
- We may retain data as required by law and professional obligations
- Provisions regarding confidentiality, liability, and indemnification survive termination
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
Any disputes arising from these Terms or use of the Portal shall be resolved in the state or federal courts located in Denver, Colorado.
Alternative Dispute Resolution
Before filing any lawsuit, parties agree to attempt resolution through good faith negotiation and, if necessary, mediation.
These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement regarding Portal use.
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
Failure to enforce any provision does not constitute a waiver of future enforcement of that provision.
You may not assign your rights under these Terms. We may assign our rights without restriction.
We are not liable for failures or delays caused by circumstances beyond our reasonable control.
